Terms of Service

These Terms of Service (“Terms”) govern access to and use of the website at puzzlepackstudio.com and the services provided through it (the “Service”), operated by Puzzle Pack Studio, established in the United States (“we”, “us”, “our”). By accessing or using the Service you agree to be bound by these Terms. If you do not agree to them, you must not use the Service.
1. The Service
The Service generates word search puzzle books as PDF files from word lists and layout parameters supplied or selected by the user. Output is generated deterministically from a seed value, such that identical inputs and seed produce identical output.
We may modify, add to, or discontinue features of the Service at any time. The contents of the topic library may change as material is added, corrected or removed.
2. Accounts
An account is required to download generated files. Building and previewing does not require an account. Authentication is by emailed link or by a third-party identity provider; no password is stored.
You are responsible for maintaining control of the email address registered to the account, and for all activity occurring under the account. An emailed sign-in link constitutes sufficient authentication to access the account.
Accounts are for use by a single individual. You may not share access credentials, permit use of the account by others, or resell access to the Service.
3. Ownership of generated output
We claim no ownership of, and assert no rights over, any file generated by you using the Service. You may reproduce, distribute, publish and sell such files, under your own name and through any channel, without restriction, royalty, per-unit fee, or attribution requirement.
This applies equally to output generated from the topic library and to output generated from word lists supplied by you.
Rights granted under this section survive termination of your account and any discontinuation of the Service. Files already downloaded remain yours without further condition.
4. Restrictions
You may not:
- redistribute, publish or resell the topic library, or any substantial part of it, as word list data;
- resell, sublicense or provide access to the Service to third parties;
- use automated means to extract the topic library or to generate output at a volume or rate that degrades the Service for other users;
- circumvent, or attempt to circumvent, any limit applied to your plan;
- use the Service for any unlawful purpose.
Where a plan is described as providing unlimited use, that refers to the absence of a metered quota. It does not authorise the activities listed above. A technical limit applies to the number of puzzles in a single generation request, set substantially above ordinary use.
5. Plans, fees and payment
A free plan and a paid plan are offered. Current prices and the limits applicable to each plan are set out on the pricing page and form part of these Terms.
The paid plan is a subscription, billed in advance on a monthly or annual basis, which renews automatically until cancelled. Payment is processed by a third-party payment processor. We do not receive or store payment card details. Applicable sales tax or value added tax is calculated and added at checkout.
Cancellation and refunds are governed by our Refund Policy.
We may vary prices. A subscription in effect at the time of a variation retains its existing price until the end of its current billing period. Notice of a price variation will be given by email to affected subscribers before it takes effect.
6. Suspension and termination
You may terminate these Terms at any time by ceasing to use the Service and requesting deletion of your account by email to hello@puzzlepackstudio.com.
We may suspend or terminate an account which is in breach of these Terms, which is used fraudulently, or whose use adversely affects the Service or other users. Where we terminate a paid account otherwise than for cause, we will refund the unused portion of the current billing period.
7. Disclaimer of warranties
The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted or error-free, or that output generated by it will be accepted by, or meet the specifications of, any print or publishing platform. Such specifications are determined by the platform concerned and may change without notice. Verification of a file against the current requirements of the intended platform is your responsibility.
8. Limitation of liability
To the maximum extent permitted by law, our aggregate liability arising out of or relating to these Terms or the Service shall not exceed the total amount paid by you to us in the twelve months preceding the event giving rise to the claim.
We shall not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data, or business opportunity, whether or not foreseeable.
Nothing in these Terms excludes or limits liability which may not lawfully be excluded or limited.
9. Indemnity
You agree to indemnify and hold us harmless against any claim, demand, loss or expense arising from your use of the Service, from output you publish or distribute, or from your breach of these Terms.
10. Privacy
Our processing of personal data is described in our Privacy Policy, which forms part of these Terms.
11. Amendment
We may amend these Terms from time to time. Where an amendment materially affects your rights, notice will be given by email to subscribers before it takes effect. Continued use of the Service after an amendment takes effect constitutes acceptance of the amended Terms.
12. Governing law and jurisdiction
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law provisions. The courts of that jurisdiction shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms, save that nothing in this section deprives a consumer of the protection of mandatory provisions of the law of their country of residence.
13. General
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions continue in full force. Our failure to enforce any provision does not constitute a waiver of it. These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and us in relation to the Service.
